Service Terms and Conditions

I. General Definitions

  • Terms and Conditions – these terms and conditions
  • Service – the online service "ififashionshop.com", operating at https://ififashionshop.com
  • Service Provider – company "Ewa Wawrzycka – Iconic & Fashion & Image IFI" with its registered office at: Kamieni 5/7U, 55-002 Dobrzykowice, VAT ID: 8942607485,
  • Service User – any natural person accessing the Service and using the services provided through the Service by the Service Provider.
  • Electronic Communication – communication between the parties via e-mail and contact forms available on the website.

II. General Provisions

  • These Terms and Conditions define the rules of operation and use of the Service and set out the rights and obligations of the Service Users and the Service Provider related to the use of the Service.
  • The subject of the Service Provider’s services is to provide free tools in the form of the Service, enabling Service Users to access content in the form of posts, articles, audiovisual materials, or online applications and electronic forms.
  • Any content, articles, and information containing features of advice or guidance published in the Service are only a general collection of information and are not directed at individual Service Users. The Service Provider shall not be liable for their use by Service Users.
  • The Service User takes full responsibility for the manner of using the materials made available within the Service, including for their use in accordance with applicable law.
  • The Service Provider does not provide any warranty as to the usefulness of the materials posted in the Service.
  • The Service Provider shall not be liable for any damages incurred by Service Users of the Service or third parties in connection with the use of the Service. All risks related to the use of the Service, and in particular to the use of the information placed in the Service, are borne by the Service User using the Service.

III. Conditions of Use of the Service

  • Use of the Service by each Service User is free of charge and voluntary.
  • Service Users are required to read the Terms and Conditions and other documents forming its integral part and must accept its provisions in full in order to continue using the Service.
  • Service Users may not use any personal data obtained in the Service for marketing purposes.
  • Technical requirements for using the Service:
    • a device with a display capable of displaying web pages,
    • internet connection,
    • any web browser that displays websites in accordance with the standards and provisions of the W3C Consortium and supports websites made available in HTML5,
    • enabled JavaScript support,
    • enabled Cookie support
  • To ensure the security of the Service Provider, Service Users, and other Service Users using the Service, all Service Users should follow the generally accepted internet security rules,
  • The following actions, performed personally by Service Users or using software, are prohibited:
    • without written consent, decompilation and analysis of the source code,
    • without written consent, causing excessive load on the Service server,
    • without written consent, attempting to detect vulnerabilities in the Service security or server configuration,
    • attempting to upload or inject into the server or database code, scripts, or software that may harm the Service software, other Service Users, or the Service Provider,
    • attempting to upload or inject into the server or database code, scripts, or software that may track or steal data of Service Users or the Service Provider,
    • any actions aimed at damaging, blocking the operation of the Service, or preventing the Service from fulfilling its intended purpose.
  • In the event of detection of an occurrence or potential risk of a Cybersecurity incident or GDPR breach, Service Users should first report this to the Service Provider in order to promptly remove the problem/threat and protect the interests of all Service Users of the Service.

IV. Conditions and Rules of Registration

  • Service Users may use the Service without registering.
  • Service Users must be registered and have an account in the Service to use additional services provided in the Service, available only to logged-in Service Users.
  • Registration in the Service is voluntary.
  • Registration in the Service is free of charge.
  • Each Service User may have only one account in the Service.
  • Technical requirements related to account registration:
    • having an individual e-mail account,
  • Service Users registering in the Service consent to the processing of their personal data by the Service Provider to the extent that such data has been entered into the Service during the registration process and any subsequent modifications or deletion thereof.
  • The Service Provider has the right to suspend or delete Service Users’ accounts at its sole discretion, thereby preventing or restricting access to certain or all services, content, materials, and resources of the Service, especially if the Service User violates the Terms and Conditions, generally applicable law, social norms, or acts to the detriment of the Service Provider or other Service Users, the legitimate interests of the Service Provider, or third parties cooperating or not cooperating with the Service Provider.
  • All services of the Service may be changed as to their content and scope, added or removed, and may also be temporarily suspended or restricted in access, at the sole discretion of the Service Provider, without the possibility of objection in this respect by Service Users.
  • Additional security rules regarding account use:
    • Registered Service Users are prohibited from sharing their login and password to their account with third parties.
    • The Service Provider does not have the right and will never request the Service User’s password for their account.
  • Account deletion:
    • Each Service User with an account in the Service may independently delete their account from the Service.
    • Service Users may do so after logging in to the Service panel.
    • Deleting an account results in the removal of all Service User’s identifying data and anonymization of the username and e-mail address.

V. Terms of the Newsletter Service

  • Service Users may use the Service without subscribing to the Newsletter.
  • Subscribing to the Newsletter service is voluntary.
  • Subscribing to the Newsletter service is free of charge.
  • Technical requirements related to the Newsletter service:
    • having an individual e-mail account,
  • Terms of the Newsletter service:
    • providing an individual e-mail account in the electronic form,
    • verification of the provided e-mail account by activating the link sent to it,
    • consenting to receive e-mail notifications,
  • Scope of the Newsletter service:
    • notifications about new updates, posts, contests, and other promotional activities related to the Service,
    • notifications about promotional activities of the Service’s partners (marketing messages),
  • Unsubscribing from the Newsletter service:
    • Each Service User subscribed to the Newsletter service may independently unsubscribe from the Service.
    • Service Users may do so via the link included in each e-mail message sent.
    • Unsubscribing from the Newsletter service results in the removal of the provided e-mail address from the Service Provider’s database.

VI. Conditions of Communication and Provision of Other Services in the Service

  • The Service provides services and tools enabling Service Users to interact with the Service in the form of:
    • Contact form
    • Commenting on posts and articles
    • Publishing their own content in the form of posts and articles
    • Publishing their own content in the form of graphic and multimedia materials
  • The Service provides contact details in the form of:
    • E-mail address
    • Contact telephone number
  • In the event of contact between the Service User and the Service Provider, the personal data of Service Users shall be processed in accordance with the "Privacy Policy", which forms an integral part of the Terms and Conditions.
  • Conditions for posting content by Service Users in the Service:
    • It is forbidden to post content in the Service that is offensive or defamatory to the Service Provider, other Service Users, third parties, or third-party entities,
    • It is forbidden to post in the Service textual, graphic, audiovisual materials, scripts, programs, and other works for which the Service User does not hold a license, or for which the copyright holder has not consented to free publication,
    • It is forbidden to post in the Service vulgar, pornographic, erotic, or illegal content under Polish or European law, as well as links to websites containing such content,
    • It is forbidden to post in the Service scripts and programs that excessively burden the server, illegal software, software used to breach security, and other similar actions, as well as links to websites containing such materials,
    • It is forbidden to post in the Service marketing or advertising content for other commercial services, products, services, or commercial websites.

VII. Collection of Data about Service Users

For the proper provision of services by the Service, for the legal protection of the Service Provider’s interests, and in order to ensure compliance of the Service’s operation with applicable law, the Service Provider collects and processes certain data about the Users through the Service.

For the proper provision of services, the Service uses and stores certain anonymous information about the Service User in cookies.

The scope, purposes, method, and rules of data processing are available in the annexes to the Terms and Conditions: "GDPR Information Obligation" and in the "Privacy Policy", both forming an integral part of the Terms and Conditions.

  • Data collected automatically:
    To ensure the efficient operation of the Service and for statistics, we automatically collect some data about the Service User. These include:
    • IP address
    • Browser type
    • Screen resolution
    • Approximate location
    • Pages visited within the Service
    • Time spent on a specific page
    • Operating system type
    • Previous page address
    • Referring page address
    • Browser language
    • Internet connection speed
    • Internet service provider
    • Anonymous demographic data based on Google Analytics:
      • Gender
      • Age
      • Interests
    • Anonymous data necessary for serving ads:
      • Remarketing-related data
      • Ad impression reporting data

    The above data is obtained via the Google Analytics script and is anonymous.

  • Data collected during registration:
    Username, full name, e-mail address

    For logged-in Service Users (with an account in the Service), cookies stored on the Service User’s device may contain a User identifier associated with the Service User’s account.

  • Data collected when subscribing to the newsletter:
    e-mail address

VIII. Copyright

  • The owner of the Service and copyright to the Service is the Service Provider.
  • Some data published in the Service is protected by copyright belonging to companies, institutions, and individuals not affiliated in any way with the Service Provider, and is used under licenses obtained or based on free licenses.
  • Based on the Copyright Act of February 4, 1994, it is forbidden to use, copy, reproduce in any form, or store in search systems (except Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, and LinkedIn search engines) any articles, descriptions, photos, or any other content, graphic, video, or audio materials contained in the Service without written consent or consent provided through Electronic Communication by their rightful owner.
  • According to the Copyright Act of February 4, 1994, simple press information, understood as mere information without commentary or author’s assessment, is not subject to copyright protection. The author interprets this as the possibility of using information from texts published in the Service, but not copying the whole or part of articles unless explicitly stated otherwise in a given material made available in the Service.

IX. Amendments to the Terms and Conditions

  • All provisions of the Terms and Conditions may be unilaterally amended at any time by the Service Provider, without providing reasons.
  • Information about amendments to the Terms and Conditions will be sent electronically to Service Users registered in the Service.
  • In the event of amendments to the Terms and Conditions, the provisions shall come into force immediately after publication for Service Users without an account in the Service.
  • In the event of amendments to the Terms and Conditions, the provisions shall come into force with a 7-day transition period for Service Users with accounts in the Service registered before the amendments.
  • It shall be deemed that each Service User continuing to use the Service after amendments to the Terms and Conditions accepts it in full.

X. Final Provisions

  • The Service Provider shall not be liable in any way, to the extent permitted by applicable law, for content transmitted and published in the Service by Service Users, for their accuracy, reliability, authenticity, or legal defects.
  • The Service Provider shall make every effort to ensure that the Service’s services are offered continuously. However, it shall not be liable for disruptions caused by force majeure, unlawful interference by Service Users, third parties, or external automated programs.
  • The Service Provider reserves the right to change any information posted in the Service at a time of its choosing, without prior notice to Service Users using the Service.
  • The Service Provider reserves the right to temporarily, completely, or partially shut down the Service for the purpose of improving it, adding services, or carrying out maintenance, without prior notice to Service Users.
  • The Service Provider reserves the right to permanently shut down the Service without prior notice to Service Users.
  • The Service Provider reserves the right to assign, in whole or in part, any of its rights and obligations related to the Service, without the consent or possibility of objections by Service Users.
